This presentation will discuss the legal and economic challenges to regulating public utilities. It analogizes public utility regulation to bank regulation, explains why it is difficult for regulators to use liability rules and other price-based deterrence mechanisms to discipline utilities ex post, and argues that regulators and policymakers should therefore apply principles from financial regulation to the regulation of electric utilities.
